R-CALF Pleased on Court's Ruling on Corporate Transparency Act

Several lawsuits have been filed challenging the Corporate Transparency Act, and a Texas court has moved quickly, ruling the ACT unconstitutional and instituting a preliminary injunction on it. R-CALF CEO, Bill Bullard.

“They have issued a preliminary injunction, meaning that the requirements of the law do not need to be met. The government can't enforce the law while the lawsuit continues to proceed. So the Texas lawsuit will continue to proceed, and the ultimate goal is to have a permanent injunction, to have the law declared unconstitutional permanently.”

Other cases, including archives lawsuit filed in a district court of Utah, are still ongoing.

“We're still watching this very closely. We're pleased, of course, with this recent development, and very happy that producers are not going to have to spend the money now in order to comply with what we view to be as an unconstitutional law, and now the court just said the same thing. And so this is good news, and I think it's going I think ultimately, what we're going to see is this law is going to be stricken down as an unconstitutional law.”

If the temporary injunction becomes permanent, R-Calf USA lawsuit would cease as the issue would be fully resolved under the CTA, producers would have had to file the information as of January 1, 2025.
