Does EID Rule Fall Under Chevron Deference?

Today kicks off part one of a two-part series discussing the new USDA Electronic Identification rule and the overturning of Chevron Deference. The EID rule, set to take effect in November, mandates that all adult cattle crossing state lines must have an EID tag. Congresswoman, Harriet Hageman and Senato,r Cynthia Loomis from Wyoming have submitted letters and resolutions of disapproval in their respective chambers to oppose this mandate. R-CALF, United Stock Growers of America, CEO Bill Bullard thinks that the Chevron Deference overturning can provide the opportunity to litigate the EID rule.

 

“This is under the Congressional Review Act, and it provides the opportunity for Congress to overturn rules that they do not like and that represent government overreach, and certainly with the Secretary of Agriculture mandating the exclusive use of a single identification device, along with forcing producers to have to pay for that device, We believe is ripe for the resolution of disapproval. So when filed in the house, they're seeking house support. So we're asking all our members to call all their members of Congress, urging them to support the resolution of disapproval that will overturn the USDA Mandatory Electronic Identification or EID rule.”
