Motion Filed to Strike Down WOTUS Amidst EPA Rewrite

WOTUS here in the headlines…again. I’ve said it before and will say it again – it is the headline that keeps on giving! Even when you see some form of finality, it’s never really done.

Here’s the update. Agriculture groups have now asked a federal court in Texas to strike down the Biden administration's waters of the U.S. rule. This comes even as the EPA had announced last week it would rewrite and issue a new proposed rule by Sept. 1.

Those agricultural groups do include the National Cattlemen’s Beef Association and American Farm Bureau Federation among others. They’ve officially filed a motion for summary judgement in the U.S. District Court for the District of Southern Texas in Galveston, telling the court the recent ruling by the Supreme Court in Sackett v EPA establishes that the Biden rule is "unlawful."

Important to note here is that this is the Texas court previously issued a preliminary injunction against the rule for the states of Texas and Idaho.
