 What about another side to the H.R.4717 bill that we’ve been discussing with agtivists for the last two days…I’m David Sparks and I’ll be fair and balanced in a minute. Legislation before the House of Representatives is a bill entitled   H.R.4717 - To require the Attorney General of the United States to compile, and make publically available, certain data relating to the Equal Access to Justice Act, and for other purposes. As you know I’ve been talking to members of The Western Legacy Alliance who support 4717 because they believe it will begin the process of uncovering how deep-pocketed environmental groups and their army of lawyers have abused the Equal Access to Justice Act receiving millions in taxpayer dollars to advance their agenda.

 I called Nick Woychick, District Civil Chief in the U.S. Attorneys Office: “With the Equal Access to Justice Act it’s not just simply a matter of here’s my bill, pay it. It’s a matter of demonstrating to the court’s satisfaction that a party has actually prevailed in the action has attained some shift in the status quo pursuant to some judicial fiat, judgement or decree or decision, and that the party is eligible to receive fees and that the position of the U.S. and the agency who’s actions are challenged was not substantially justified.”
