Renewable Fuels Association Disappointed With Court Decision

“ Well, we're obviously very disappointed with this decision out of the DC Circuit. You might remember that back in April of 2022 and then again, a few months later, in June of 2022 EPA denied all of those small refinery exemption petitions that were pending before the agency, and they actually reversed some petitions that had been earlier approved, and we felt like they had every reason in the world to do that those refiners had not demonstrated that the RFS had caused them any sort of harm economic and certainly no disproportionate economic harm.”

 

That is Renewable Fuels Association president and CEO, Geoff Cooper, commenting on the recent US Court of Appeals DC circuit order on vacating most of the Environmental Protection Agency's 2022 denials of petitions for small refinery exemptions from the Renewable Fuel Standard obligations, and remanding those petitions to EPA for further proceedings.

 

“We have always felt like EPA analysis of these petitions in recent years has been sound. It has been well reasoned and it's backed by real-world experience. You can go look at the earning statements, stock prices, or any other measure for these refineries. .”

 

Cooper says that the RFA will continue to work to keep refiners from using loopholes to exploit the program.
